Among the Personal Data collected by Dyamach, either independently or through third parties, are: name, surname, phone number, company name, address, email, postal code, various types of Data, city, website, Usage Data, Cookies.Complete details on each type of data collected are provided in the respective sections of this privacy policy or through specific information displayed prior to data collection.Personal Data may be freely provided by the User or, in the case of Usage Data, collected automatically while using Dyamach.Unless otherwise specified, all Data requested by Dyamach is mandatory. If the User refuses to provide such Data, it may become impossible for Dyamach to provide its Service. Where Dyamach explicitly states that some Data is optional, Users are free not to communicate such Data without affecting the availability or operation of the Service.Users who are uncertain about which Data is mandatory are encouraged to contact the Controller.The use of Cookies—or other tracking tools—by Dyamach or by the third-party service providers used by Dyamach, unless otherwise specified, serves the purpose of providing the Service requested by the User, as well as for the additional purposes described in this document and the Cookie Policy, if available.The User is responsible for any third-party Personal Data obtained, published, or shared through Dyamach and confirms they have the third party's consent to provide the Data, releasing the Controller from any liability.
Methods and Place of Data Processing Processing Methods
The Controller adopts appropriate security measures to prevent unauthorized access, disclosure, modification, or destruction of Personal Data.Data processing is carried out using computers and/or IT-enabled tools, following organizational procedures and methods strictly related to the purposes indicated.In addition to the Controller, in some cases, the Data may be accessible to specific parties involved in the operation of Dyamach (such as administrative, sales, marketing, legal staff, or system administrators) or external parties (such as third-party technical service providers, mail carriers, hosting providers, IT companies, or communication agencies) appointed, if necessary, as Data Processors by the Controller. The updated list of these parties may be requested from the Controller at any time.
Legal Basis for Processing
The Controller processes Personal Data relating to the User if one of the following applies:
- The User has given their consent for one or more specific purposes; Note: In some jurisdictions, the Controller may be allowed to process Personal Data without the User’s consent or any other legal basis specified below, as long as the User does not object to such processing (“opt-out”). This does not apply when the processing of Personal Data is subject to European data protection law.
- Processing is necessary for the performance of an agreement with the User and/or for any pre-contractual obligations;
- Processing is necessary for compliance with a legal obligation to which the Controller is subject;
- Processing is necessary for the performance of a task carried out in the public interest or in the exercise of official authority vested in the Controller;
- Processing is necessary for the purposes of the legitimate interests pursued by the Controller or a third party.
It is always possible to request the Controller to clarify the specific legal basis that applies to the processing and to specify whether the processing is based on the law, required by a contract, or necessary to enter into a contract.
Place
The Data is processed at the Controller’s operating offices and in any other locations where the parties involved in the processing are located. For further information, contact the Controller. The User's Personal Data may be transferred to a country other than their own. To find out more about the location of such processing, the User can refer to the section detailing the processing of Personal Data. The User is also entitled to learn about the legal basis of Data transfers to a country outside the European Union or to any international organization governed by public international law, such as the UN, and about the security measures taken by the Controller to safeguard their Data. Retention Period
The Data is processed and stored for as long as required by the purpose for which it has been collected. Therefore:
- Personal Data collected for purposes related to the performance of a contract between the Controller and the User is retained until the contract has been fully performed.
- Personal Data collected for the purposes of the Controller’s legitimate interests is retained as long as needed to fulfill such purposes. Users may find specific information regarding the legitimate interests pursued by the Controller within the relevant sections of this document or by contacting the Controller.
When processing is based on the User’s consent, the Controller may retain Personal Data for a longer period until such consent is withdrawn. Furthermore, the Controller may be obliged to retain Personal Data for a longer period in compliance with a legal obligation or by order of an authority. Once the retention period expires, Personal Data will be deleted. Therefore, the right to access, delete, rectify, and the right to data portability cannot be enforced after the expiration of the retention period.
Purposes of Processing the Collected Data
The Data concerning the User is collected to allow the Controller to provide its Services, comply with legal obligations, respond to enforcement requests, protect its rights and interests (or those of its Users or third parties), detect any malicious or fraudulent activity, as well as for the following purposes: contacting the User and displaying content from external platforms. Personal Data is collected for the following purposes and using the following services:
Contacting the User
- Contact Form: By filling in the contact form with their Data, the User authorizes Dyamach to use these details to reply to requests for information, quotes, or any other kind of request as indicated in the form. Personal Data processed: name, surname, company name, email, phone number, and various types of Data.
Displaying Content from External Platforms
- YouTube Video Widget and Google Maps Widget: These services allow the display of content hosted on external platforms directly from the pages of Dyamach and enable interaction with them.
Personal Data processed: Cookies, Usage Data.
- Google Fonts: This service provides font styles and collects usage data as specified in its privacy policy.
Personal Data processed: Usage Data and other Data as specified in the service’s privacy policy. User Rights Users may exercise certain rights regarding their Data processed by the Controller.In particular, Users have the right to:
- Withdraw their consent at any time. Users have the right to withdraw consent where they have previously given their consent to the processing of their Personal Data.
- Object to Data processing. Users have the right to object to the processing of their Data if the processing is carried out on a legal basis other than consent. Further details are provided in the section below.
- Access their Data. Users have the right to learn if Data is being processed by the Controller, obtain disclosure regarding certain aspects of the processing, and obtain a copy of the Data undergoing processing.
- Verify and seek rectification. Users have the right to verify the accuracy of their Data and request it to be updated or corrected.
- Restrict the processing of their Data. Users have the right, under certain circumstances, to restrict the processing of their Data. In this case, the Controller will not process their Data for any purpose other than storing it.
- Have their Personal Data deleted or otherwise removed. Users have the right, under certain circumstances, to obtain the erasure of their Data from the Controller.
- Receive their Data and have it transferred to another controller. Users have the right to receive their Data in a structured, commonly used, and machine-readable format and, if technically feasible, to have it transmitted to another controller without any hindrance. This provision is applicable provided that the Data is processed by automated means and that the processing is based on the User’s consent, on a contract of which the User is part, or on pre-contractual obligations thereof.
- Lodge a complaint. Users have the right to bring a claim before their competent data protection authority.
Details about the Right to Object
Where Personal Data is processed for a public interest, in the exercise of an official authority vested in the Controller, or for the purposes of the legitimate interests pursued by the Controller, Users may object to such processing by providing a ground related to their particular situation to justify the objection.Users should know that, however, if their Personal Data is processed for direct marketing purposes, they can object to that processing at any time without providing any justification.To find out whether the Controller is processing Personal Data for direct marketing purposes, Users can refer to the relevant sections of this document.
